By accessing or using the CoCreateWorks website or any of our services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services. These terms apply to all visitors, users, and creators who access or use our platform.

CoCreateWorks provides creator management services including but not limited to: 24/7 chat management, social media growth strategy, revenue optimization, content protection, branding and marketing, and account management across platforms such as OnlyFans, Fansly, Fanvue, and others. The specific scope of services for each creator is defined in individual partnership agreements.

You must be at least 18 years of age to use our services. By using our services, you represent and warrant that you are at least 18 years old, have the legal capacity to enter into a binding agreement, are not prohibited from using our services under applicable laws, and all information you provide is accurate and truthful.

Application Process

Submitting an application does not guarantee acceptance into our program. We reserve the right to accept or decline any application at our sole discretion. All applicants must provide accurate, complete, and truthful information.

Partnership Terms

Accepted creators will enter into a separate, detailed partnership agreement that outlines specific service terms, revenue sharing arrangements, contract duration, exclusivity clauses, and termination conditions. These individual agreements, combined with these Terms of Service, constitute the full agreement between CoCreateWorks and the creator.

Revenue & Payments

Creators receive earnings directly from their respective platforms according to each platform's payout schedule. CoCreateWorks partnership fees are calculated and handled as outlined in individual partnership agreements. We do not charge upfront fees for our standard services.

As a creator partnered with CoCreateWorks, you agree to: comply with all applicable laws and platform terms of service, provide timely access to accounts necessary for us to perform our services, communicate professionally with our team and respond to communications in a reasonable timeframe, not engage in fraudulent, misleading, or illegal activities, maintain the confidentiality of proprietary strategies and methods shared with you, and not circumvent or undermine the services we provide.

CoCreateWorks commits to: performing services with reasonable skill and care, maintaining confidentiality of your personal and account information, acting in your best interest within the scope of our partnership, providing transparent reporting on performance metrics and activities, complying with all applicable data protection laws, and keeping you informed of material changes that affect your account.

All content on the CoCreateWorks website, including text, graphics, logos, images, and software, is the property of CoCreateWorks or its content suppliers and is protected by copyright and intellectual property laws. Content created by creators remains the intellectual property of the respective creator. Strategies, templates, scripts, and methodologies developed by CoCreateWorks are proprietary and may not be shared, reproduced, or used outside of the partnership without written consent.

Both parties agree to maintain strict confidentiality regarding proprietary information, business strategies, financial data, and any other sensitive information exchanged during the partnership. All CoCreateWorks team members are bound by non-disclosure agreements (NDAs). Breach of confidentiality may result in immediate termination and legal action.

CoCreateWorks provides services on a best-efforts basis. We do not guarantee specific results, earnings, subscriber counts, or growth metrics. To the maximum extent permitted by law, CoCreateWorks shall not be liable for: any indirect, incidental, special, consequential, or punitive damages, loss of revenue or profits, platform policy changes or account restrictions imposed by third-party platforms, or damages resulting from unauthorized access to your accounts by third parties. Our total liability for any claim arising from our services shall not exceed the total fees paid to CoCreateWorks in the six months preceding the claim.

Either party may terminate the partnership in accordance with the terms outlined in the individual partnership agreement. CoCreateWorks reserves the right to immediately terminate services if a creator: violates these Terms of Service, engages in illegal activities, breaches confidentiality, or acts in a manner that harms the reputation of CoCreateWorks. Upon termination, all obligations under these terms survive to the extent necessary to enforce any rights or obligations that accrued prior to termination.

You agree to indemnify, defend, and hold harmless CoCreateWorks, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: your use of our services, your breach of these Terms, your violation of any third-party rights, or any content you create or distribute through the platforms we manage.

Any disputes arising from these Terms of Service or our services shall first be attempted to be resolved through good-faith negotiation between the parties. If negotiation fails, disputes will be resolved through binding arbitration in accordance with the rules of the applicable arbitration authority in the jurisdiction specified in your partnership agreement. Each party shall bear their own costs of arbitration unless otherwise determined by the arbitrator.

CoCreateWorks reserves the right to modify these Terms of Service at any time. Material changes will be communicated to active creators via email or through our platform. Continued use of our services after changes are posted constitutes acceptance of the updated terms. If you disagree with any changes, you may terminate your partnership in accordance with your partnership agreement.

These Terms of Service shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any legal action or proceeding relating to these Terms shall be brought exclusively in the courts of the applicable jurisdiction.
